By accessing and using qual-a's white label music distribution platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

qual-a provides white label music distribution technology that enables partner companies to offer music distribution services under their own brand. Our platform includes:
- Music distribution to digital streaming platforms
- Analytics and reporting tools
- Revenue management systems
- Content protection services
- Marketing and promotional tools
- API access and integration support
3. Partnership Requirements
Eligibility
To become a white label partner, you must:
- Be a legally established business entity
- Have relevant experience in the music industry
- Meet our technical and operational requirements
- Complete our application and verification process
- Agree to our partnership agreement terms
Partner Responsibilities
- Provide accurate company and contact information
- Comply with all applicable laws and regulations
- Maintain appropriate licenses for music distribution
- Implement proper artist verification procedures
- Handle customer support for your end users
4. Intellectual Property
Our Rights
qual-a owns all rights to the platform technology, software, and related intellectual property. Partners receive a limited, non-exclusive license to use our platform under the agreed terms.
Partner Content
Partners retain ownership of their brand assets and content. You grant us necessary rights to provide the white label service, including displaying your branding within the platform.
End User Content
Partners are responsible for ensuring they have proper rights and licenses for all content distributed through their platform, including music tracks, artwork, and metadata.
5. Service Level and Support
- We aim for 99.9% platform uptime
- 24/7 technical support for critical issues
- Regular platform updates and improvements
- Dedicated account management for enterprise partners
- Training and onboarding assistance
6. Fees and Payment
Pricing and payment terms are specified in individual partnership agreements. Generally:
- Setup fees may apply for platform customization
- Ongoing fees based on usage or revenue sharing
- Additional charges for premium features or support
- Payment terms typically net 30 days
- Late payment may result in service suspension
7. Data and Privacy
Data handling is governed by our Privacy Policy and Data Processing Agreement. Key points:
- Partners control their end user data
- We process data only as instructed by partners
- Both parties must comply with applicable privacy laws
- Data security measures are implemented throughout
- Data portability available upon termination
8. Prohibited Activities
Partners and their users must not:
- Distribute copyrighted content without proper authorization
- Engage in fraudulent or deceptive practices
- Attempt to reverse engineer or compromise our platform
- Use the service for illegal activities
- Spam or send unsolicited communications
- Violate any third-party rights
9. Limitation of Liability
To the maximum extent permitted by law, qual-a shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Service interruptions or technical failures
- Third-party platform issues or changes
- Content-related claims or disputes
Our total liability is limited to the fees paid by the partner in the 12 months preceding the claim.
10. Termination
By Either Party
Either party may terminate the agreement with 30 days written notice for convenience, or immediately for material breach that remains uncured after 15 days notice.
Effect of Termination
- Access to the platform will be discontinued
- Data export period of 30 days provided
- Outstanding payments remain due
- Confidentiality obligations survive termination
11. Changes to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated to partners with at least 30 days notice. Continued use of the service constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be resolved through binding arbitration or in the courts of England and Wales.
